Who we are

Xomia is a service operated by Xomia Inc., a Delaware corporation (United States). Contact: contact@xomia.ai.

Your account

You must be of legal age in your country (and at least 18) to use Xomia.

You sign in with an identity provider (for example Google). You are responsible for access to your account and for what is done with it.

If you use Xomia for a business, you confirm you are authorized to bind it.

The service

Xomia generates video ads, visuals, scripts, voices and films using artificial intelligence models, some of which are provided by third-party partners and providers.

Xomia is an AI and can make mistakes: an output may be imperfect, inaccurate or different from what you expected. Always review your ads before publishing them.

The service may evolve, and some features or models may change or be temporarily unavailable.

Credits, subscriptions and payment

Prices, credits and plans are shown on the Pricing page. Payments are processed by Stripe.

A subscription renews automatically each period. You can cancel at any time: it stays active until the end of the period already paid.

Credits can only be used in Xomia, have no cash value and are neither refundable nor transferable, unless the law requires otherwise. If a generation fails for a technical reason, credits are returned automatically. A generation refused by the model’s safety filter because of the content provided (prohibited content, a brand or a real person without rights) uses the credits.

If you are a consumer in the European Union, you request that the digital service start immediately and acknowledge that you lose your right of withdrawal once credits are used, within the limits set by law.

What you upload

You keep all your rights in what you upload: links, photos, logos, texts, voices, videos.

You warrant that you hold the necessary rights in this content, including in the brands, products and likeness of the people shown. A website’s pages and images remain the property of their authors.

You grant Xomia a limited license to process this content solely to provide the service (analysis, generation, storage, display).

Ads and videos created

Within the limits of the law and of our providers’ terms, you may use the content created for you commercially.

AI outputs may resemble other content. Xomia does not guarantee their exclusivity or the absence of third-party rights in what you provided.

You are responsible for publishing them and for complying with the advertising and consumer rules of your country and of the platforms (TikTok, Instagram, Facebook, X).

Prohibited uses

No illegal, misleading, defamatory, hateful or violent content, no sexual content involving minors, no content that violates privacy.

No impersonation of a real person without consent, no fake testimonials presented as real, no trademark or copyright infringement.

No attempt to bypass limits, overload, scrape or resell the service without written agreement.

We may remove content or suspend an account that breaks these rules.

Publishing and Agent

If you connect your social accounts or use Xomia Agent, posts go out with your approval. You remain responsible for what is published on your accounts.

Xomia’s property

The software, the Xomia brand, the logo, the ad templates and the website remain the property of Xomia Inc. These terms give you no rights in them beyond using the service.

Seedance, Grok, Claude, NVIDIA and other brands mentioned belong to their respective owners.

Liability

The service is provided “as is”. To the extent permitted by law, Xomia does not guarantee uninterrupted operation or any commercial result.

To the extent permitted by law, Xomia’s total liability is limited to the amounts you paid Xomia in the last 12 months. Nothing in these terms limits rights that the law of your country grants you and that cannot be excluded.

Ending the service

You can stop using Xomia and ask for your account to be deleted at any time by writing to contact@xomia.ai.

We may suspend or close an account in case of breach of these terms, fraud or security risk.

Personal data

How we process your data is described in our privacy policy at xomia.ai/privacy.

Changes

We may update these terms. For any important change, we will notify you before it applies. The update date is shown at the top of this page.

Governing law

These terms are governed by the laws of the State of Delaware (United States), without depriving a consumer of the protection of the mandatory rules of their country of residence or of their right to bring proceedings in the courts of that country.
